1] Heard learned counsel for the applicant.

2] Rule. Rule made returnable forthwith. None present for respondent though served.

3] Learned counsel for the applicant contends that it is difficult for the applicant to prosecute proceedings in Marriage Petition No.427/2016 lodged by present respondent in the Family Court No.3 at Pune as the applicant is without any source of livelihood, is illiterate and is living in Ahmednagar District and has

MCA 216/16 - 2 - to depend absolutely on her parents. Her parents' economic condition as well is not sound. There is nobody to accompany her to visit Pune on the dates before the Court.

4] All the aforesaid contentions of the applicant have gone un-controverted in the absence of the respondent, who is absent in spite of service, and to a large extent may reflect a tacit acceptance of veracity in request of the applicant.

5] In the circumstances, it would be expedient to grant the application. The Miscellaneous Civil Application is allowed in terms of prayer clause (A). The Marriage Petition No.427/2016 pending in the Family Court No.3 at Pune be transferred to competent Court at Ahmednagar. Rule is made absolute accordingly. The application stands disposed of.
