Applicant is seeking transfer of H.M.P. No. 17/2022 filed by the Respondent/husband before Civil Judge Senior Division, Nandurbar to Dhule. It is the contention of learned counsel for the Applicant that she has no source of income and has responsibility of four years son. It is also claimed that two proceedings under Protection of Women from Domestic Violence Act and for maintenance are pending at Dhule.

According to learned counsel for the Applicant, in any case, the Respondent will have to attend these two proceedings at

- 2 - mca186.23.odt Dhule and as such no prejudice will be caused to the Respondent if H.M.P. No. 17/2022 is transferred from Nandurbar to Dhule. 3.

Absence of Respondent/husband inspite of service of notice indicates that he has no inclination to oppose the application. 4.

Contention of Applicant has gone unchallenged. No prejudice will be caused to the Respondent if the proceeding is transferred as asked for, as in any case, Respondent is required to attend two proceedings filed against him by wife at Dhule. 5.

In the above circumstances, Application is allowed in terms of prayer clause 'B'. It is clarified that in order to ensure that the husband is not harassed by keeping these three proceedings on different dates for hearing, the concerned Courts are hereby directed to keep hearing of these three proceedings or any other proceeding filed by wife on the same day. It shall be the responsibility of the wife to inform this order to the concerned Courts. ( R. M. JOSHI) Judge dyb
