PER COURT :- The petitioner claims to belong to scheduled tribe(ST) and has been admitted to B. Pharmacy course conducted by respondent No.2 as against a seat reserved for ST category. The petitioner has already cleared 1st year examination and is desirous of securing admission to second year course. As a result of failure of the petitioner to tender validation certificate, it is informed that respondent No.2 has refused to admit the petitioner to next year course. In the facts and circumstances, this petition stands disposed of with direction to respondent No.3 scrutiny committee to take decision on the tribe certificate verification proposal of the petitioner, pending with respondent No.3 committee, as expeditiously as possible and preferably within a period of eight months from today. Respondent No.

2 is directed to permit the petitioner to prosecute further studies, subject to fulfillment of eligibility conditions. Respondent No.2 shall not deny admission to the next year course to the petitioner, merely on the ground of his failure to submit validation certificate and the admission to the course conducted by respondent No.2 shall be subject to outcome of the tribe certificate validation proposal pending with respondent No.3 committee.
