PER COURT :- 1.

By this Civil Application the applicant seeks permission to rely upon the document annexed at Exhibit-X, as a part of the record and evidence in First Appeal No. 1562 of 2007 and seeks condonation of delay in filing the Civil Application.

Learned Counsel for the respondent No.2 fairly states that the document sought to be relied upon by the applicant by this Civil

(2) FA No.9141/2017 Application in First Appeal was already referred to and relied upon in the proceedings before the trial Court. He has no objection if the document is allowed to be referred at the time of hearing of this First Appeal. 3.

Mr. Borulkar, Learned A.G.P. also makes the similar statement. 4.

Civil Application is accordingly made absolute in terms of Prayer Clause 'B' & 'C'. The applicant as well as respondents would be permitted to rely upon the document annexed at Exhibit-X to the Civil Application at the time of hearing of First Appeal No. 1562 of 2007. 5.

No order as to cost.

Place First Appeal No. 1562 of 2007 on board for hearing on 07.09.2017.
