Versus

The State of Maharashtra & others Respondents Mr.S.S.Thombre, advocate for the petitioner Mrs.A.V.Gondhalekar, A.G.P. for Respondents No.1 to 5. CORAM : R.M.BORDE & P.R.BORA, JJ.

DATE : 13th August, 2015 PER COURT:

The order impugned in this petition at Exhibit-N dated 08.07.2015 issued by the District Supply Officer, directing suspension of authorisation issued in favour of the petitioner to operate the Fair Price Shop, is appealable to the Deputy Commissioner (Supply).

It is an allegation that the order has been issued by the District Supply Officer as a result of influence exercised by the local MLA and without holding proper inquiry. It would be open for the appellate authority to look into the grievance of the petitioner in accordance with the provisions of law. The appellate authority shall decide the appeal on its own merits and in accordance with law without being influenced by the intervention of non Governmental officials either local MLA or any

In view of the above directions, Writ Petition stands disposed of.
