IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD 17 WRIT PETITION NO.8055 OF 2015 NAGESH RAMDAS PATIL

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioner : Mr. Patil Vijay Y.

Mr. AV Deshmukh, AGP for Respondents:1 To 4.

____ CORAM :

S.S.SHINDE & P.R.BORA,JJ.

DATE :

5 th February, 2016.

PER COURT :

1) Heard. The grievance of the petitioner is that, though the representation/applications dated 18th March, 2014 and 19th March, 2014 are submitted before the District Collector, Aurangabad, the same are not decided as yet.

2) The learned AGP appearing for the State, relying upon the contents in the affidavit in reply, submits that the post-retiral benefits, for which, the petitioner is entitled to, are being paid to the petitioner.

3) The petition raises disputed questions of fact. In that view of the matter, we deem it appropriate to direct the District Collector,

WP No. 8055/2015 Aurangabad to look into the aforesaid applications/representations filed by the petitioner and after verifying the relevant record, maintained by the concerned office, take appropriate decision on its own merits, as expeditiously as possible and preferably within a period of three months from today.

4) It is made clear that in case the some of the post-retiral benefits have already paid to the petitioner, the same need not be extended to the petitioner.

5) With these directions the petition stands disposed of.
