The petitioner No. 1 was appointed by the petitioner No. 2 management, which is a minority institution as a Shikshan Sevak. By the impugned order the Education Officer (Primary) has refused to grant approval on the ground that she has not passed the T.E.T.

The decision of this Court holding that the provisions regarding mandatory T.E.T. is applicable even to minority institutions is under challenge before the Supreme Court, which has granted status quo.

The Education Officer shall take fresh decision on its own merits and shall not refuse to grant approval on the grounds mentioned in the impugned communication. The decision shall be taken as expeditiously as possible and in any case within a period of six (06) weeks from today. The approval would be subject to the decision in the matter before the Supreme Court. The writ petition is disposed of.
