The petitioner has attained the age of superannuation. 2.

The learned AGP submits that the Education Officer has already forwarded the proposal for payment of provisional pension to the Accountant General, Nagpur (Page 30).

The criminal case is pending against the petitioner. As such, petitioner would be entitled for provisional pension. The Accountant General, Nagpur shall process the proposal for the provisional pension (page 30) expeditiously and preferably within a period of three months and shall grant the provisional pension as admissible and payable to the petitioner.

The respondent shall also take a decision within a period of three months with regard to the payment of gratuity to the petitioner.

The writ petition is disposed of. No costs.
