The learned advocate Mr. Kazi for the petitioners submits that, the order impugned in the petition is an order passed by the learned Member, M.R.T., Aurangabad dated 06.08.2009. By way of impugned order the learned Member allowed the revision petition and quashed the order passed by the learned Deputy Collector dated 19.04.2003 impugned in the said revision. The matter was remanded for fresh decision to the learned Deputy Collector. He further submits that, though there is no stay in the

2 932-wp 7104-2009.odt matter, the learned Deputy Collector has still not decided the appeal. He submits that now the petitioners are also not interested in prosecuting this writ petition. He further prays that the learned Deputy Collector be directed to decide the proceeding at the earliest.

Considering the above submissions, the writ petition stands disposed of with a direction to the learned Deputy Collector, Dharashiv to decide the proceeding No. 1988/TNC/A/13 pending before him within a period of twelve (12) weeks from today. 3.
