This is a Civil Application seeking condonation of delay of 26 days in filing the First Appeal against the judgment and award dated 09.03.2023 passed by the learned Motor Accidents Claims Tribunal, Beed in M.A.C.P. No. 34 of 2021.

The learned counsel for the applicant submits that the delay is not inordinate nor has been caused due to lethargy or negligence on the part of the applicant.

For the reasons stated in the application, the Civil Application is allowed in terms of prayer clause "B". The delay of 26 days caused in filing the First Appeal is hereby condoned.

Registry to register the First Appeal on condition that the applicant shall remove all the office objections within two weeks from today.

After registration of the First Appeal, issue notice to the respondents, returnable on 25.09.2025.

The matter be place after service is complete. In the meantime, the appellant/applicant shall take recourse to Chapter II of the Bombay High Court Appellate Side Rules, 1960, corresponding to the requirement in the matter.
