Heard the learned counsel for the applicant.

By this application, the applicant (original accused No.2) namely Imitiyajbi w/o Akbar Shah, who was convicted and sentenced by the Trial Court for the offence punishable under Section 307 of the Indian Penal Code, wants to withdraw this application, whereby she has claimed the benefit of Probation of Offenders Act. Her appeal filed against her conviction and sentence, bearing Criminal Appeal No. 456 of 2001 has been dismissed by this Court on 25th April, 2017 and now she is undergoing the sentence of imprisonment.
