IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 8544 OF 2019 Umesh Madhukar Wani .. Petitioner

Versus

The State of Maharashtra and Another .. Respondents Mr. G. V. Wani, Advocate for Petitioner.

Mr. V. M. Kagne, AGP for Respondent No. 1- State. Mr. A. S. Bajaj, Advocate for Respondent No. 2. CORAM :

S. V. GANGAPURWALA & MANGESH S. PATIL, JJ DATED : 25th JULY, 2019.

PER COURT:- 1.

Heard Mr. Wani, the learned Counsel for the petitioner. The learned Counsel submits that the maximum age limit has to be increased up to 43 years for the persons competing from reserved category and 38 years for the persons competing from open category. According to the learned Counsel, the State Government have increased the maximum age limit. The respondent No. 2 has to implement the Government Resolution dated 25.04.2016 enhancing the maximum age limit for selection and appointments. 2.

Mr. Bajaj, the learned Counsel submits that the other two sister companies referred by the petitioner are independent companies. The respondent company is incorporated under the provisions of companies Act and has independent and distinct legal entity and is not part of the

2 903-WP8544-19.doc Government.

3.

It appears that the MSEDCL has framed its own classification and recruitment regulation 2005 and the age limits are provided therein. Upper age limit provided for selection through nomination is 27 years for the post of Assistant Electrician and Technician.

4.

In view of the policy decision of the respondent, the petitioner cannot seek extension of age as of right.

5.

The reliance placed on Government Resolution dated 25.04.2016 would not be of any benefit to the petitioner in as much as the same applies to the selection through MPSC and for the employment in different Government Departments.

6.

In light of the above, Writ Petition is disposed of. No costs. ( MANGESH S. PATIL ) ( S. V. GANGAPURWALA ) JUDGE JUDGE P.S.B.
