Learned counsel appearing for the appellant/ applicant files on record the written instructions dated 22.02.2015, received from the appellant/applicant for withdrawal of the present appeal as well as the certified copy of the compromise arrived at before the Motor Accident Claims Tribunal, Majalgaon. Both documents are taken on record and marked "X" and "X1", respectively, for the purpose of identification. Learned counsel further submits that the matter is settled and therefore, the appellant wishes to withdraw the present appeal.

Accordingly, the first appeal is allowed to be withdrawn and disposed of as such without any order as to costs. The court fees refund, as per the Rules, is permitted.

In view of settlement between the parties, the present appellant is allowed to withdraw the statutory deposit made by her in this Court.

In view of disposal of the first appeal as withdrawn, civil application No. 1887/2008 does not survive and hence, stands disposed of.
