Petitioner claims to belong to "Maratha" caste, which was declared as educationally and socially backward caste under the Maharashtra Ordinance No.XIII of 2014. The petitioner has been admitted to Engineering Course as against a seat reserved for aforesaid category.
The Division Bench of this Court, in the matter of Sanjeet Shukla Vs. State of Maharashtra, reported in 2015 (2) BomCR 267, was pleased to direct stay of operation of Ordinance issued by the State Government on 9th July, 2014. However, while issuing interim order, this Court has protected the admissions
{2} wp798916.odt already granted in the educational institutions till issuance of order of stay based upon the impugned Ordinance No.XIII of 2014 and Government Resolution dated 15th July, 2014 and it is further directed that such admissions shall not be disturbed and those students shall be allowed to complete their respective courses. The petitioner has approached this Court for protection of admission secured by him to Respondent No.5-College. It is noticed that petitioner has been admitted to the College in the academic year 2014-15 and has already completed third year engineering course. In this view of the matter, petitioner shall be permitted to continue engineering course and RespondentUniversity shall declare result of the petitioner and shall also permit him to appear for next examination.
With the directions as above, writ petition stands disposed of.
