The learned counsel submits that the petitioner has preferred an appeal against the judgment and order of his conviction passed in connection with the Criminal Case and the said appeal is still pending before the High Court Bench at Aurangabad. The petitioner's nomination form for contesting the election of member of Zilla Parishad came to be rejected on this ground alone. In case, if the appeal preferred by the petitioner is allowed, the petitioner would be at liberty to contest the election in future. This matter pertains to the filing of the nomination of the election of the Zilla Parishad of the year 2008. Thus, by passage of time, this Writ Petition has

become infructuous.

In view of the same, the Writ Petition is hereby dismissed as infructuous. Rule discharged. The Writ Petition is accordingly disposed off.
