This is an application for bail under Section 439 of Code of Criminal Procedure. The applicant has been arrested in connection with Crime No. 27 of 2022 registered with Harsool Police Station, Dist. Aurangabad for the offences punishable under Sections 394, 395, 120B and 402 of the Indian Penal Code.

Heard. Perused the First Information Report ("F.I.R.") and related police papers.

The co-accused have been granted bail. On investigation, the charge-sheet has been filed. The gold ornaments have been recovered from the applicant. The deficit is of Rs.70,000/-. The applicant, on his own, 1 / 2
961-BA-1228-22.odt expressed his willingness to deposit that much amount. In view of the same and the fact that on investigation the charge-sheet has been filed, the Court is inclined to grant the applicant bail.

In view of above, the application deserves to be allowed. Hence I pass the following order :-
ORDER
(I) The bail application is allowed.
(II) The applicant be released on bail, in connection with Crime No. 27 of 2022 registered with Harsool Police Station, Dist. Aurangabad for the offences punishable under Sections 394, 395, 120B and 402 of the Indian Penal Code, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount.
(III) The applicant shall deposit a sum of Rs.1,00,000/-. Out of the same, depositing the amount of Rs.70,000/- is a condition precedent for release on bail and balance amount of Rs.30,000/- be deposited within six months thereafter.
(IV) The applicant shall not tamper with the prosecution evidence.
