Present application has been filed for condoning the delay of 482 days in filing Second Appeal. The respondent is served, however, he has not appeared and contested the application.

Heard learned Advocate Mr. P.K. Deshmukh for applicants. Taking into consideration the fact that though the notices were issued to the respondent, he failed to appear and the application has gone unchallenged. The applicants are contending that due to their weak financial condition they could not make the arrangements for the expenditure of the

CA_14351_2016 Second Appeal, and therefore, there is delay. Though delay is huge, but taking into consideration the reasons stated therein, it stands condoned. Application stands allowed and disposed of. Registry to verify and register the Second Appeal.
