Mr. Jadhav, the learned counsel for the petitioner states that, the respondents are not considering the claim of the petitioner for direct appointment on Class III or Class IV posts as nominee of Freedom Fighter. Same is contrary to their policy. The respondents have given benefit to the freedom fighter by one hand and on the other hand denying the said benefit. Some of the persons are directly appointed as freedom fighter's nominee. The same is denied to the petitioner.

The learned A. G. P. submits that, the petitioner had participated in the examination. He could only secure 84 marks out of 200. The said marks are far less than other meritorious

2 wp 7150.11 candidates who are selected for the post of talathi. The petitioner applied from the open category. The last candidate selected from open category has secured 170 marks out of 200. 3.

We have considered the submissions canvased by the learned counsel for respective parties.

The petitioner had participated in the selection process, but having secured less marks could not be selected. There is no policy to directly appoint the nominee of freedom fighter by the State Government. In view of that, case of the petitioner cannot be considered. However, in future any policy is adopted by the State, the same be considered. The writ petition is disposed of. No costs.
