By this application, the applicant is seeking relaxation of condition in the order dated 28th March, 2024 passed by this Court (Coram : Nitin B. Suryawanshi, J.) while allowing Criminal Application No.895 of 2024.

It is contention of the learned counsel for the applicant that while allowing the Bail Application initially this Court had imposed condition on the applicant that he shall attend the concerned police station on every Sunday from 28.01.2024 onwards, between 10.00 a.m. to 11.00 a.m. and shall co-operate in the investigation. Thereafter, this Court by order dated 28th March, 2024, modified the said condition that the petitioner shall attend the concerned police station on 1st and 3rd Saturday of every month, between 10:00 a.m. to 11:00 a.m. It is contention of the learned counsel for the applicant that the applicant is Chartered Accountant. Due to his profession he has to travel various places. He is facing the difficulties to attend the police station as

2922.2024APPLN.odt directed by this Court and to manage his various commitments, hence requested to relax the condition to attend the police station. The learned counsel further submitted that the investigation is almost completed.

It is contention of the learned APP that the allegations levelled against the applicant are serious. His presence is required before the Investigating Officer to know about the details in the crime. Yet chargesheet has not been filed. Investigation is in progress, hence requested to reject the application.

I have heard both the learned counsel.

It appears that since November, 2023, the applicant is regularly attending the concerned police station. He has cooperated in investigation. The applicant is Chartered Accountant. Considering this fact, I pass the following order :-

ORDER

(i) The application is allowed.

(ii) The applicant shall attend the concerned police station as and when required by the Investigating Officer.

(iii) The Investigating Officer shall inform 48 hours in advance to the applicant about his attendance before him.

(iv) The bail condition is modified as above.
