In the present writ petition, Original plaintiff is the Petitioner and Original Defendants No.1, 2 and 3 are Respondents No.1, 2 and 3. 2.

The learned counsel appearing for the original defendants no.2 and 3 submits that they would not cross-examine defendant no.1, whose evidence is given in examination-in-chief. 3.

Therefore, the learned counsel appearing for the petitioner / original plaintiff submits that in view of the statement of learned counsel for defendants no.2 and 3, nothing survives in the writ petition and that he would cross-examine the defendant / witnesses. 4.

Since, the suit is pending for a long period of time on account of stay of trial by this court, the trial court to decide the same as

2 943 expeditiously as possible and preferably within the outer limit of one (01) year.

The parties agree before this court that they would assist the trial court in disposing of the suit expeditiously. 5.

Considering the statement of both the parties, as above, nothing survives in the present writ petition. The Writ Petition stands disposed of with above observations.
