The Petitioner is an association of private enterprises, who is aggrieved by the terms of the invitation for bid, dated 30/06/2023. According to the Petitioner, the eligibility criteria is draconian. As a consequence of such eligibility criteria, not a single bidder has tendered any bid and the tender has been a wasteful exercise.

The learned Advocate for the Petitioner, submits on instructions that, this Petitioner has approached the Commissioner, Ground Water Survey and Development Agency

8787.23wp (2) (GSDA) by tendering a representation. The said representation is under consideration.

In view of the above, since there have been no bidders responding to the invitation for bidding and as the technical bids have not been opened, thereby rendering the said activity time barred as per the contention of the Petitioner, this petition is disposed off.

Needless to state, if a fresh tender is published/floated and the Petitioner has any grievance, it would be at liberty to seek redressal. Similarly, if the Petitioner is not happy with the decision on it's representation, it may be at liberty to avail of the remedy, as may be permissible in law.
