Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.274 of 2024 registered with Gandhi Chowk Police Station, District Latur for the offence punishable under Sections 328, 188, 272, 273 of the Indian Penal Code and Section 59 of Food Safety and Standards Act. 3.
Except Section 328, other sections are bailable. The applicant was apprehended with Gutka. Whether Section 328 applies to the said case is a question. The muddemal has been recovered. 4.
The learned APP submits that he is a habitual offender. 5.
In the circumstances, instead of refusing bail, certain stringent conditions may be imposed. Hence, the following order :

O R D E R
(i) Bail Application is allowed.
(ii) Applicant, Sami Jakiyoddin Sayyad, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses and shall attend the trial on each and every date.
(b) The applicant shall furnish an undertaking before the police that he would not involve in similar crime in future.
(c) If he is involved in similar crime, the prosecution may file an application for cancellation of bail.
