Learned Advocate for the applicant is absent. 2.

When the matter was on board on 03.10.2024, it was pointed out by learned APP that charge-sheet is filed before the Trial Court and now the Non Bailable warrant has been issued against the present applicant, who is accused No.4. Today, learned APP is producing the Roznama/Daily Status from ECourts Services showing that warrant has been issued against the present applicant. It appears that it is issued against other accused persons also. Even on the last occasion, we had expressed that if the present applicant is not appearing before the [1]

903-appln-2316-2019.odt concerned Court and warrant is issued against the applicant, then this Court may not exercise its powers under Section 482 of the Code of Criminal Procedure in favour of the applicant. Under the pretext of/guise of filing the present application, the applicant cannot remain absent before the concerned Court and, therefore, we dismiss the application.
