By the present application under section 439 of the Code of Criminal Procedure, the applicant seeks his release on bail, in connection with C.R. No.48 of 2016, registered with Ambajogai (Rural) police station, for offences punishable under sections 498-A, 306, 304-B read with section 34 of the Indian Penal Code.

The applicant was arrested on the next day of the incident, i.e. 22 nd June, 2016.

It is the case of the prosecution that Deepak, younger brother of the applicant, was married to deceased Shilpa, who died of burn injuries. The death of Shilpa is within seven years of marriage. As such, the crime in question came to be registered.

The applicant has already undergone custodial interrogation. There is hardly anything which is required to be recoverred or investigated into as against the applicant, for which his custodial detention is warranted. 5.
Apart from above, the role attributed to the applicant in the first information report and other investigation papers speaks of his indirect involvement.

In view thereof, in my opinion, it will be appropriate to enlarge the applicant on bail. I, therefore, pass following order :- The applicant be released on bail, in connection with C.R. No.48 of 2016, registered with Ambajogai (Rural) police station, for offences punishable under sections 498-A, 306, 304-B read with section 34 of the Indian Penal Code, on furnishing P.R. Bond of Rs.15,000/- with one surety in the like amount.
The applicant shall not tamper with prosecution evidence or influence witnesses.
