IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 936 WRIT PETITION NO.8649 OF 2022 NIDA AHMED ALI SAYYAD

VERSUS

UNION OF INDIA THROUGH FINANCE DEPARTMENT AND OTHERS ...

Advocate for Petitioner : Mrs. Seema T Pawar Advocate for Respondent No.1 : Mr. S.W. Munde .....

CORAM : RAVINDRA V. GHUGE AND SANJAY A. DESHMUKH, JJ.

DATED : 19th OCTOBER, 2022.

PER COURT :- 1.

The petitioner, in response to the communication dated 17.5.2022, has applied for student loan to respondent No.5. On 21.7.2022, a fresh loan application is tendered. On 04.08.2022 i.e. on 15th day, this writ petition is filed seeking direction to respondent No.5 to consider the application of the petitioner. Seeking a writ of mandamus within 15 days of the filing of an application, in our view, is an abuse of the process of law.

2.

We are, therefore, not entertaining this petition and the same is disposed off.

3.

Let respondent No.5 decide the loan application of the petitioner on it's merits, if there is no other legal impediment. (SANJAY A. DESHMUKH, J.) (RAVINDRA V. GHUGE , J.) rlj/
