Sheshrao Shripatrao Kawale v. The State Of Maharashtra And Others
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD CIVIL APPLICATION NO. 11219 OF 2015 IN WP/2890/2013 SHESHRAO SHRIPATRAO KAWALE
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Applicant : Shri Solunke Narayan R. AGP for Respondent 1 : Shri Korde D.R.
Advocate for Respondents 2 & 3 : Shri Kedar B.R. ...
CORAM : RAVINDRA V. GHUGE, J.
Dated: April 01, 2016 ...
PER COURT :- 1.
The limited grievance of the applicant is that the order dated 10.4.2013, passed by this Court in Writ Petition No.2890 of 2013 should not be an impediment for the learned Deputy Collector, Jalna who is seized with ROR Appeal No.213/12082/ROR/CR-107.
2.
Shri Kedar, learned Advocate for the non-applicant / original petitioner submits that the petitioner has assailed the judgment of the Maharashtra Revenue Tribunal dated 6.2.2013 in Case No.29/A/2009/J. This Court, by its order dated 10.4.2013, has stayed the said judgment and it has nothing to do with the proceedings pending adjudication before the Deputy Collector, Jalna. He, therefore, submits that this application has been filed out of a mis-conception and the apprehension of the applicant is misplaced. 3.
I have considered the submissions of the learned Advocates. 4.
In the light of the above, the learned Deputy Collector shall note that the order of this Court dated 10.4.2013, passed in Writ Petition No.2890 of 2013 has not created any embargo on the hearing before him in ROR Appeal No.213/12082/ROR/CR-107. As such the Deputy Collector, Jalna is at liberty akl/d
