Heard the learned Advocate for the Applicant and the learned APP for the State. Perused the papers on record. 2.
It is the case of the Prosecution that, the Prosecutrix and the Applicant are working in the Police Department. They came in contact with each other and became friendly. They fell in love. The Applicant expressed his wish to marry with the Prosecutrix and had sexual intercourse with her from time to time. When the Prosecutrix asked to marry, the parents of the Applicant demanded dowry. The parents of the Prosecutrix did not accede to the said demand. The relations continued. Again when the Prosecutrix asked the Applicant about marriage, the Applicant refused and told her that he is going to marry another girl and threatened her that he would viral photographs.
2 938ABA1186.2025.odt The Informant approached the Police and lodged the report, upon which Crime bearing No. 0255 of 2025 came to be registered with Mukundwadi Police Station, District Chhatrapati Sambhajinagar City, against the Applicant, for the offences punishable under Sections 69, 351(3), 352 of the Bharatiya Nyaya Sanhita, 2023, and Section 4 of the Dowry Prohibition Act, 1961.

Undisputedly, the Prosecutrix was major and working in the Police Department. It is clear that, they were knowing each other. The statements of witnesses have been recorded. The panchanama of the places where the Applicant and the Prosecutrix had visited is conducted. The Applicant is ready to handover mobile phone to the Investigating Machinery. Considering the nature of accusations against the Applicant in the FIR, investigation is possible without the custodial interrogation of the Applicant. In this view of the matter, I proceed to pass the following order:
ORDER
[i] In the event of arrest of the Applicant, namely, Sunil s/o Jivba Jaybhaye, in connection with Crime No. 0255 of 2025 registered with Mukundwadi Police Station, District Chhatrapati Sambhajinagar, he be released on bail on his furnishing P.B. of Rs. 30,000/- [Rupees Thirty Thousand] with one or two sureties in the like amount.
3 938ABA1186.2025.odt [ii] The Applicant shall attend Mukundwadi Police Station, District Chhatrapati Sambhajinagar, on 14th to 16th October, 2025, between 11:00 am to 02:00 pm, and thereafter, as and when called.
[iii] The Applicant shall not tamper with the prosecution evidence in any manner, whatsoever.
[iv] The Applicant shall cooperate with the Investigating Machinery [v] The Application stands disposed off.
