Heard learned counsel for the parties. At the very outset, attention of the Court is drawn to the order dated 7 August 2024, by which the Applicant was protected. Certain terms and conditions were imposed in the said order. Pursuant thereto, Mr. Lavte, learned APP has taken instructions. He would on instructions submit that the Applicant has cooperated with the investigation by complying with the terms and conditions of the said order. There is no breach in this regard. Thus it can be inferred that he has duly joined investigation. Mr. Lavte submits on instructions that the statement of this Applicant has been recorded. Also that the Investigating Officer is seized with the necessary documents in regard to the loan which was availed by the present Applicant. The investigation has substantially progressed. There is nothing adverse brought on record by the prosecution against the Applicant as far as prima facie case is concerned after the order dated 7 August 2024.

Thus for all the above reasons, the order dated 7 August 2024 deserves to be confirmed. Thus the following order is passed:-

ORDER

(i) In the event of arrest of the Applicant in connection with CR No.0454 of 2024 registered with Sangamner City Police Station, Ahmednagar for the offence punishable under Section 420 of the Indian Penal Code, 1960, the Applicant is directed to be released on bail on his furnishing PR bond in the sum of Rs.20,000 (Rupees Twenty Thousand Only) with one or more sureties in the like amount.

(ii) The Applicant shall cooperate with the investigation and shall attend the concerned police station as and when required, until filing of the charge-sheet.

(iii) The Applicant shall furnish details of residential address and other contact details such as mobile number etc. to the concerned police station. If there is any change in the contact details, the same shall be immediately intimated to the concerned police station.

(iv) The Applicant shall not leave the jurisdiction of the Court without prior permission/order of the Court, until filing of the charge-sheet.

(v) The Applicant shall not influence the witness/es and/or tamper evidence in any manner whatsoever.

Needless to mention that the observations made above are prima facie for the purposes of adjudicating this Application. 4.
