There is no dispute that the petitioner is squarely covered by the view taken by this Court at the Principal Seat vide order dated 11/03/2020 in WP No.3719/2019 filed by Smt.Prema Narsinha Herkal Vs. State of Maharashtra and others.

The learned Advocate for the Management fairly submits that the Management was not aware of this position of Law. The pension papers of the petitioner by including his earlier service as a part time Librarian in accordance with the view taken in Smt.Prema case (supra), would khs/Mar.2022/1193

- 2 - be forwarded to the competent authority within 3 (three) weeks from today.

As such, we direct the Education Officer to take a decision on the concerned pension proposal within 2 (two) weeks from the date of receipt of the papers from the Management.
