Heard Mr. Tribhuwan, learned counsel for the petitioner.

The learned counsel submits that, the petitioner and other candidates had raised objections to the candidature of respondent no.5. The respondent no.5 was not possessing the qualification as on the date of the advertisement. The respondents are not considering the objections. 3.

The learned A.G.P. appears for respondent nos.1 and 2. Mr. Suryawanshi, learned counsel appears for respondent nos.3 and 4.

The learned counsel submits that, prior to the issuance of the appointment order, the objections filed by the petitioner (Page No.43) would be decided by respondent no.4.

In view of that, we are not required to consider the contentions on merits.
