The learned counsel for the petitioner states that on humanitarian grounds the case of the petitioner be considered. The petitioner was placed in the list of candidates meant for giving appointment on compassionate ground. However, before the turn of the petitioner could come, the petitioner has crossed 45 years of age. The learned counsel submits that the letter dated 19.06.2015 be quashed and set aside. The learned counsel, in alternate, submits that the son of the petitioner would become major within six months. His claim be considered for appointment on compassionate ground. 2.
The learned Additional Government Pleader for respondents submits that as per the Government Resolution, the maximum age
WP7867.15 -2limit for appointment on compassionate ground is 45 years, as such, the case of the petitioner cannot be considered. 3.
The Rules/Policy cannot be moulded. The petitioner has crossed 45 years of age, as such, certainly cannot be considered for appointment on compassionate ground.

In case the petitioner's son makes an application seeking appointment on compassionate ground, the respondent shall consider his application on its own merits, in accordance with law and policy. The writ petition is disposed of. No costs. ( V. K. JADHAV, J.) ( S. V. GANGAPURWALA, J. ) vre/
