The learned counsel for the petitioner, on instructions, submits that during the pendency of this Writ Petition, petitioner died. The learned counsel submits that the legal heirs of the petitioner are not interested in prosecuting this Writ Petition. This Writ Petition pertains to the disqualification of the petitioner on the ground of a third child born to him after the cut off date. Since the said objection raised by the other side was sustained and the petitioner held to be disqualified, the petitioner had approached to this court by filing the present Writ Petition. The Writ Petition has become infructuous due to the death of the petitioner so also for the

reason that the legal heirs of the petitioner are not interested in prosecuting the Writ Petition.

The Writ Petition is hereby dismissed as infructuous. Rule discharged.
