It is an application for suspension of sentence and bail moved by the appellant/accused.
Heard Mr. Salunke, learned counsel for appellant, Mr.Deshmukh, learned APP for the respondent No.1/State and Mrs. A. S. Mantri, learned appointed counsel for respondent No.2. Mr. Salunke, learned counsel for appellant/applicant, on instructions, seeks to withdraw this application when this Court has expressed disinclination to grant bail to the appellant by suspending the sentence during appeal period. He submits that leave may be granted to the applicant/ appellant to move an application after six months for expeditious final hearing of the appeal.

O R D E R
I.
The application stands dismissed as withdrawn. II.
The appellant is at liberty to move an application for expeditious hearing of the criminal appeal after six months.

Mrs. A. S. Mantri, learned counsel is appointed to espouse the cause for respondent No.2 Her professional fees is fixed at Rs.5,000/-. The Secretary, High Court Legal Services Sub Committee, Aurangabad, is hereby requested to make payment of professional fees of Rs.5,000/- (Rupees Five Thousand Only) to Mrs. A. S. Mantri, learned appointed counsel appearing for respondent No.2.
