Learned counsel for the applicant, accused submits that due to non-communication of the date, the Applicant did not remain present and the Advocate also did not remain present due to misunderstanding. This Court has issued non-bailable warrant on 16th July, 2015. 3.

The case was filed for offence under the provisions of Prevention of Food Adulteration Act. Considering the submissions made, N.B.W. can be cancelled subject to

-:(2):- payment of Rs.500/- by way of penalty. The amount is to be deposited in High Court Legal Services Sub Committee, Bench at Aurangabad. The application is disposed of accordingly.

The appeal will be heard on 17th August, 2015. On that day the accused and the learned counsel for the accused should remain present and argue the matter otherwise N.B.W. will be issued.
