This matter was heard for some time. The learned advocate for the petitioner submits that even if the respondents open the tender in order to assess as to who is the lowest bidder, the petitioner would be satisfied.

The learned counsel representing the Zilla Parishad places before us a copy of the order dated 10.8.2022 passed in Writ Petition No. 6411/2022 filed by Ganesh Haribhau Khande Vs. The State of Maharashtra and others, regarding the same Jal Jeevan Mission (ty thou fe'ku). We had ordered in paragraph No. 3 of the order dated 10.8.2022 that, "In the event a fresh tender is floated, the same shall not be finalised until the next date of hearing in this matter".

The learned AGP submits that the Zilla Parishad has, therefore, not opened any tender arising out of Jal Jeevan Mission. 4.

We are of the view that we had not created an embargo on the Zilla Parishad to the extent of opening the tender. What we have ordered is that the tenders would not be finalized till the next date in Writ Petition No. 6411/2022.

In view of the above, this petition is disposed off, by permitting the Zilla Parishad to open the tenders, but not to finalize the same until further orders in Writ Petition No. 6411/2022. [ARUN R. PEDNEKER J.] [RAVINDRA V. GHUGE, J.] SSC/
