Versus
The State of Maharashtra and others .. Respondents Ms. Vishakha Patil, Advocate h/f Talekar and Associates, Advocate for the Petitioner.
Shri N. S. Tekale, A.G.P. for the Respondent Nos. 1 to 3. CORAM : MANGESH S. PATIL & SHAILESH P. BRAHME, JJ.
DATE : 22 OCTOBER 2024.
FINAL ORDER :
.
Though request has been made by the learned advocate for the petitioner on instructions seeking leave to withdraw the PIL, in the normal course request could have been treated as innocuous, but going by the prayers made, purely a personal grievance was sought to be agitated and the relief was claimed, it is clearly an abuse of process of law in filing such public interest litigation.
2.
We allow the petition to be withdrawn and dispose it of subject to petitioner depositing cost of Rs. 5,000/- (Rs. Five thousands only) in this Court within four (04) weeks from today, else the amount shall be recovered as arrears of land revenue. [SHAILESH P. BRAHME J.] [MANGESH S. PATIL, J.] bsb/Oct. 24
