The Petitioner has approached this Court without being served with any notice directing him to remove the purported encroachment. The Petition is, therefore, premature.

The learned Advocate for the Petitioner submits that if a notice is served upon the Petitioner, he also has a remedy of preferring an appeal against the said notice under section 24 of the Maharashtra Highways Act, 1955.

In view of the above statement, this Writ Petition is disposed off.
