Heard the learned counsel for the applicant and the learned A.P.P for the respondent State.

The applicant seeks bail in Crime No. 255 of 2022 registered with Kranti Chowk Police Station, District Aurangabad for the offences punishable under Sections 396, 120(B) of Indian Penal Code. 3.

Similarly situated co-accused has been granted bail. Hence, the applicant deserves parity. Hence, the following order :-

ORDER

(i) The application is allowed.

(ii) Applicant Mohammed Niyaz Mohammed Ibrahim Choudhary be

B. and S.B. of Rs. 50,000/- each with one solvent surety of the like amount, in aforementioned crime registered with aforementioned police station, on the following conditions :- (a) He shall not tamper with the prosecution witnesses. (b) He shall furnish his mobile phone number to the Police Station with an undertaking that he will not change the same till the conclusion of the trial.
