1] By the present petition, the petitioner challenges the order dated 11.11.2021 passed by the Family Court, Aurangabad below Exh.47 in Petition No. D38/2018, directing the respondent to complete the procedure for taking out passport of the minor son. 2] The learned counsel for the petitioner submits that the petitioner has moved an application stating therein that the petitioner has not consented for grant of the passport to the child. In the event the child is to be taken out of the country from the custody of the petitioner, the petitioner will loose custody of child. Therefore, the order directing to complete the procedure for taking out passport of the minor son is erroneous.

6793.24WP 3] If the minor son is granted passport, that would not mean that the child will be taken out of country without permission. The petitioner can approach the Family Court for appropriate relief in that regard.

4] I do not see any error in the impugned order directing to complete the procedure for taking out passport of the minor son. The present Writ Petition is dismissed. [ARUN R. PEDNEKER] JUDGE DDC
