PER COURT :- The learned counsel appearing for the applicants has tendered copy of the order passed by the Principal District Judge, Dhule on 2.12.2015 whereby the application tendered by the respondents below Exh.5 claiming stay to the execution of the Award came to be rejected. In view of this, there shall not be any impediment for the applicants to withdraw the amount deposited by the respondents in this Court. The petitioners undertake to tender an undertaking in the pending Arbitration Proceedings being Civil Miscellaneous Application No.155/2014 before the Principle District Judge, Dhule to the effect that, in the event of success of the Arbitration Proceedings, the applicants shall redeposit the amount, withdrawn by them, within a period of 12 weeks, from the date of such decision. Undertaking shall be presented within one week from today and a copy thereof shall be tendered to the Registry of the Court.
