Heard Mr. Hajare, learned advocate appearing for the applicants.

He invites attention of this Court to the order dated 7.7.2023 passed in CA No.5560 of 2020 in FA ST 14708 of 2019 and companion matters and submit that all these appeals are arising out of same acquisition and consequential award. He submits that this Court, after considering reasons as stated

ca 5404.22.odt in the application condoned the delay caused in filing the appeal/s. He invites attention of this Court to the reasons as stated in paragraph nos.2 to 5 to contend that delay is unintentional and the applicants were prevented by sufficient cause to approach this Court.

Having considered submissions advanced and averments in the application, case is made out to condone the delay, however, on the condition that the applicants shall file undertaking to the satisfaction of the Registrar (Judicial) of this Court that they shall not claim interest for the delayed period in case they succeed in appeal and awarded compensation. Civil applications are allowed in aforesaid terms and disposed off.
