Heard. This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0160/2022, registered at Dhule-City Police Station for the offences punishable under Sections 392, 395 read with Section 34 of the Indian Penal Code.

The F.I.R. was lodged against unknown person. On arrest of the applicant, he was not subjected to test identification parade. It is true that the stolen article namely gold chain has been recovered from the applicant herein. On investigation, the charge sheet has been filed. It will take

time for commencement and conclusion of the trial. Hence, this Court is inclined to allow the application. Hence the order:-

O R D E R

(i) The Bail Application is allowed.

(ii) The applicant be released on bail in connection with Crime No.0160/2022, registered at Dhule-City Police Station for the offences punishable under Sections 392, 395 read with Section 34 of the Indian Penal Code on his executing P.R. bond in the sum of Rs.15,000/- (Rupees fifteen thousand) with one surety in the like amount.

(iii) The applicant shall mark his attendance at Ambewali Police Station, Kalyan, District Thane twice a month i.e. on every Second and Fourth Sunday between 9.00 p.m. and 10.00 p.m. till conclusion of the trial.

(iv) The applicant shall not tamper with the prosecution evidence in any manner.
