VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioner : Mr.Dhengle Babasaheb A.

AGP for Respondents/State: Mr.S.B.

Yawalkar.

...

CORAM : S.S. SHINDE & SANGITRAO S. PATIL, JJ. Dated: AUGUST 02, 2016 ...

Heard the learned Counsel for the petitioner.

2.

We have perused the reply filed by the respondents. In para 5 thereof, it is stated that the petitioner does not have any disability of lower limbs (zero percent, as given in the report of Special Medical Board) though she has deformity of spine. It appears from the affidavit-in-reply that the Board has followed the consideration of eligibility criteria - relaxation to be provided for physically handicapped persons having

7974.16wp locomotory disability of lower limb.

Accordingly, the petitioner's disability is not covered under the said caption.

3.

In that view of the matter, we are unable to persuade ourselves to grant any relief to the petitioner. The petition stands disposed of.
