The petitioner wife is seeking transfer of Hindu Marriage Petition preferred by the respondent husband for restitution and pending in a Court at Latur to the Family Court at Nanded. 3.

Admittedly, by the order dated 12.09.2017 a Miscellaneous Civil Application No.111/2017, a petition that was pending in the Family Court at Bandra, Mumbai was transferred at the request of the respondent husband and with the consent of the applicant wife to the Family Court at Nanded. Admittedly, few other proceedings between the parties are going on in different courts at Nanded.

Without discussing anything more, it would be appropriate that even this matter is transferred to Nanded so that all the proceedings would remain at the same place. A possible hardship to the respondent can be 1/2

988.mca.164.19.odt obviated by directing the courts to take up the matters as far as possible on the same date.

The Application is allowed as prayed for. The Hindu Marriage Petition No.233/2016 is transferred to the Family Court at Nanded. The parties shall appear before the Family Court at Nanded on 19.07.2022. 6.

As far as possible the courts taking up different matters between the parties at Nanded shall see to it that the proceedings are listed on the same date.
