Heard learned Counsel for the applicant - wife. The respondent - husband, though served but remained absent. 2.

The applicant - wife is seeking transfer of Hindu Marriage Petition No. 96 of 2019 pending in the Court of C.J.S.D. Pandharpur filed by respondent - husband for getting divorce, to the Family Court at Dhule.

According to the applicant - wife, she is not having any independent source of income and at present she is maintaining two minor children without any financial help from the respondent - husband. Moreover, she has also filed 1/2

977-MCA-163-2019 three proceedings at Dhule, wherein the respondent - husband has already appeared. Thus, the respondent - husband anyhow will have to attend the dates at Dhule and therefore, considering the convenience of applicant - wife, following order is passed :

ORDER

(i) The application is hereby allowed.

(ii) Hindu Marriage Petition No. 96 of 2019 pending in the the Court of C.J.S.D.

Pandharpur, Dist. Solapur is transferred to the Family Court at Dhule for disposal according to law.

(iii) The respondent - husband is directed to appear before the Family Court, Dhule on or before 15th April, 2023.
