While directing cancellation of the membership of the respondents, the Society did not take recourse to the provisions of the Act and has forfeited the share amount. Since the procedure prescribed under the Act, for taking action in respect of cancellation of membership of the respondents, has not been followed, we do not find any error in the order passed by the District Deputy Registrar, which is confirmed by the Divisional Joint Registrar of Cooperative Societies, Nandurbar. If the society is of the opinion that, some amount is due and recoverable from the respondents, it would be open for the petitioner to take proper measures for enforcing recovery of the amount, within the frame work of law.

With liberty as aforesaid, writ petition is disposed of. ( R. M. BORDE, J. ) vbd
