BENCH AT AURANGABAD CRIMINAL APPLICATION NO. 4101 OF 2016 ASHOK KISAN JADHAV AND OTHERS
VERSUS
THE STATE OF MAHARASHTRA AND ANOTHER . . .
Advocate for Applicants : Mr. Atul B. Gatne. APP for Respondent/State : Mrs. P. V. Diggikar. . . .
CORAM : A. V. NIRGUDE & V. L. ACHLIYA, JJ.
DATE : 11th AUGUST, 2016.
PER COURT :
1] On perusal of complaint and upon hearing submissions at the bar, we are convinced that there is strong prima facie case against the applicants. It is apparent that, they have committed offence attempt to commit robbery. Offence under Section 384 of IPC extortion may not be made out, but contentions of FIR are not final words. The investigation be continued and proper charge sheet be filed, at least we expect the police to do so. There is no ground for interference at this stage. The Criminal Application stands dismissed.
