VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioner : Mr.Sapkal V.D.

AGP for Respondents/State: Mr.P.G. Borade.

...

CORAM : S.S. SHINDE & P.R. BORA, JJ.

Dated: JANUARY 07, 2016 ...

The learned Counsel for the petitioners has tendered across the Bar copy of the amended petition as per leave granted by this Court. The same is taken on record.

All these petitions take exception to the directions (at Exh.G) issued by the respondent No.2 Joint Director of Education (Primary), Maharashtra State, Pune to the Deputy Director of Education of all regions.

In our opinion, the petitions are premature.

As and when the petitioners receive any notice or communication from the concerned competent authority for termination of the services of the employees of the petitioners, it will be open for the concerned / affected parties to take recourse to an appropriate remedy, as may be available in law. So far grievance of the petitioner for payment of salary for the services rendered by the employees appointed by the petitioner is concerned, to that effect if proposals i.e. salary bills are already submitted by the petitioner - management, as stated in amended portion of the petition, we direct the Respondent No.3 to take decision on the said proposal, in accordance with relevant rules/procedure, as expeditiously as possible, however, preferably within 8 weeks from today. Needless to observe, the concerned authority will be entitled to verify the factual details about actual services rendered etc. of each of the

employees appointed under unit. In case, the employees are found entitled for the salary, respondent No.3 shall ensure that, they receive the salary within four weeks from decision on the salary bills submitted by the petitioner - management.

With above observations, the Petitions stand rejected. Rejection of these Petitions would not be construed as an impediment to the petitioners, so as to seek appropriate remedy before the appropriate forum in case they receive the individual notices. Petitions stand disposed of.
