Learned A.P.P. waives notice for the respondent-State.

The applicant, who has been convicted by the learned Additional Sessions Judge, Hingoli vide judgment and order dated 10/07/2015 passed in Sessions Trial No. 59 of 2011, for the offence punishable under section 411 of the Indian Penal Code and sentenced to suffer

2 Cr. Appln. 4064/2015 rigorous imprisonment for 2 years and to pay fine of Rs.2,000/-, in default to suffer rigorous imprisonment for 6 months for the said offence, is praying for suspension of the substantive sentences during the pendency of the appeal and his release on bail. 5.

Learned counsel for the applicant submits that fine amount is already deposited.

Considering the short term sentence awarded to the present applicant i.e. original accused no.2, the substantive sentences are hereby suspended. The applicant be released on bail, upon his execution of P.R. bond in the sum of Rs.30,000/- (Rs. Thirty Thousand) and also upon furnishing surety in the like amount.

Criminal Application accordingly stands disposed of.
