The Second Appeal was refused registration by the order of the Registrar dated 07.09.2016 for non removal of office objections. By this Civil Application, the Applicant prays for condonation of delay of 300 days and further prays for setting aside the order of the Registrar.
It is submitted that all office objections would be removed within a period of two weeks from today.
The learned Advocate for Respondent No.1 opposes the application. Alternatively, he prays that the costs may be imposed and the same be donated to the Advocate Association's Bar Library, High Court, Aurangabad.
*2* 11ca9534o17 For the reasons set out in the Civil Application, the same is allowed. Delay of 300 days is condoned subject to the costs of Rs.3000/- (Rupees Three Thousand) which the Applicant shall deposit with the Advocate Association's Bar Library, High Court, Aurangabad within a period of TWO WEEKS from today. After the costs are deposited, all office objections shall be removed within a period of TWO WEEKS thereafter. After the costs are deposited and the objections are removed, the order of the Registrar shall stand recalled and the Second Appeal shall be registered.
If the costs are not deposited and the objections are not removed, this order shall stand recalled, the Civil Application shall stand rejected and then the order of the Registrar shall stand restored. kps (RAVINDRA V. GHUGE, J.)
